HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.2128 of 2017 ORDER:

This writ petition is filed challenging the action of the 3rd respondent in calling the petitioner to the Police Station. Learned Government Pleader for Home, on the basis of written instructions, submits that when a notice under Section 41-A of Cr.P.C., was sought to be served, by visiting the house of the petitioner on 17.01.2017, petitioner was not available and he rushed to this Court by filing the present writ petition. It is further stated a case under Section 498-A read with Section 34 IPC is pending against the petitioner and four others. In view of the pendency of the said crime against the petitioner, it is open to the respondents to take further proceedings in accordance with law. Writ petition is accordingly closed.

Pending miscellaneous petitions, if any, shall stand closed. No costs.
