THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7552 of 2023 ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.4 and 5 seeking anticipatory bail in the event of their arrest in connection with Crime.No.111 of 2023 on the file of Amangal Police Station, registered for the offences under Sections 448, 306, 384, 323, 504 r/w 34 of Indian Penal Code. 2.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondentState and perused the record. 3.
Briefly, the case of the prosecution is that accused Nos.1 to 3 and these petitioners went to the house of the deceased on 05.06.2023 at about 05.30 P.M and abused the deceased in filthy language, suspecting that the deceased committed theft of gold ring. Insulted by the said incident, the deceased committed suicide by consuming poison on next day i.e., on 06.06.2023.

This Court by order, dated 26.07.2023 and 21.07.2023 granted relief of regular bail to accused Nos.1 to 3. Since the remand report states, that these petitioners have accompanied accused Nos.1 to 3 and no specific allegations are made, this Court deems it appropriate to grant relief of anticipatory bail to the petitioners subject to the following conditions;-
1) The petitioners/Accused Nos.4 and 5 are directed to surrender before the Station House Officer, Amangal Police Station on 21.08.2023. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos.4 and 5 on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioners/Accused Nos.4 and 5 shall appear before the concerned police every day from 21.08.2023 to 31.08.2023 at 10.00 a.m. and thereafter, as and when required for the purpose of investigation.
3) The petitioners/Accused Nos.4 and 5 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
