THE HON'BLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No. 8562 of 2025 ORDER:

This Criminal Petition is filed under Section 483(1)(b) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') by the petitioner, who is arrayed as accused No.1, seeking relaxation of the condition imposed by the IX Additional Chief Judicial Magistrate, Hyderabad vide order dated 20.06.2025 in Criminal Miscellaneous Petition No.318 of 2025.

Heard Mr.P.N.Dayakar, learned counsel for the petitioner and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondents.

Learned counsel for the petitioner submitted that pursuant to the orders passed by the learned IX Additional Chief Judicial Magistrate, Hyderabad, dated 20.06.2025 in Crl.M.P.No.318 of 2025, the petitioner/accused No.1 is appearing before the concerned Station House Officer, Chikkadpally Police Station, Hyderabad, regularly and the entire investigation is completed except filing of charge sheet and therefore, further appearance of the petitioner before the concerned S.H.O., is no more required. Unless the above said condition is relaxed, the petitioner will be put to great hardship. Therefore, he requested to relax the

condition imposed by the learned IX Additional Chief Judicial Magistrate, Hyderabad against the petitioner. 4.

Learned Additional Public Prosecutor basing upon the written instructions submitted by the Sub-Inspector of Police, Chikkadpally, submitted that entire investigation has been completed and charge sheet will be filed in due course. 5.

Taking into consideration the above said submissions and also the averments made in the criminal petition, this Court is of the considered view that the condition imposed by the learned IX Additional Chief Judicial Magistrate, Hyderabad against the petitioner vide order dated 20.06.2025 in Crl.M.P.No.318 of 2025 directing the petitioner to appear before the concerned S.H.O., Chikkadpally P.S., Hyderabad on every Monday and Friday in between 10-00 a.m. and 1-00 p.m. for a period of three months or till filing of charge sheet, whichever is earlier, is hereby relaxed. 6.

Accordingly, the Criminal Petition is allowed. As a sequel thereto, miscellaneous applications, if any, pending in this petition stand closed.
