THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2992 OF 2016 ORDER:
The Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.218 of 2015 on the file of the XXIV Metropolitan Magistrate, Miyapur, at Kukatpally, Ranga Reddy District, arising out of offences under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. Heard and perused the material available on record. Learned counsel for the petitioners submits that on the date of alleged incidence, the first petitioner was in Hyderabad and that the occurrence was not happened. He further submits that in his statement, L.W.7, who is the grandfather of the de facto complainant, stated that the complainant was sent to the petitioners' house on 30.10.2014 and as such, the incident which is allegedly happened on 14.10.
2014 was not at all happened and as such, the proceedings against the petitioners are liable to be quashed. This Court is of the view that the contentions raised by the learned counsel for the petitioners can be raised before the Court below and the Court below is competent to decide the issues after examination of the witnesses. Hence, this Court is not inclined to interfere with the proceedings initiated against the petitioners. However, the Court below is directed to dispose of the case as expeditiously as possible, preferably within a period of six months. The Criminal Petition is accordingly dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 09.03.
