HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.22752 of 2015 PC: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) This writ petition, impugns the show cause notice dated 22.6.2015, issued by the 3rd respondent directing the petitioner to show cause and explain in writing why the tax, as indicated in the notice, be not collected with penalty and compounding fee. The petitioner has submitted his reply to the show cause notice. In view thereof and having considered the overall facts and circumstances of the case, and so also, the submissions of learned counsel for the parties, we are satisfied that the following order shall meet the ends of justice.
"a) The 3rd respondent shall decide the show cause notice on merits, in accordance with law, as expeditiously as possible and preferably, within a period of three months from today. Petitioner is directed to communicate this order to the concerned authority within ten days from today.
b) In the meanwhile, if the petitioner deposits the amount of tax (i.e., Rs.7,73,291.5) and compounding fee (i.e., Rs.11.500/-), as indicated in the show cause notice, the concerned authority shall release the vehicle detained by them subject to the outcome of the show cause notice. All contentions on merits are kept open." With these observations, the writ petition is disposed of.
Consequently, pending miscellaneous applications shall also stand closed.
