HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 6539 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of certiorari calling for the record relating to and connected with I.D.No.121 of 2000 on the file of the Industrial Tribunal-cum-Labour Court, Godavarikhani, and quash the order dated 11.07.2001 passed therein confirming the order of removal of petitioner from service. A consequential direction is also sought to the respondent to reinstate the petitioner into service with continuity of service and all consequential benefits.

None appeared for the petitioner.

When the matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation during pendency of the writ petition. Therefore, at this point of time, the relief sought by the petitioner cannot be granted. However, I am of the view that the petitioner is entitled for the benefits for the service rendered by him prior to his removal from service.

Accordingly, the writ petition is disposed of directing the respondent corporation to pay the service benefits of the petitioner for the service rendered by him prior to his removal from service, if not already paid, in accordance with the Regulations, within a period of four (4) weeks from the date of receipt of a copy of this order.
