THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.15656 of 2011 ORDER:
The relief sought for in this writ petition is to declare the proceedings of the 1st respondent dated 18.04.2009 closing the application of the petitioner pursuant to the communication sent by the 2nd respondent dated 07.01.2009, with regards change of policy of the State Government, as contrary to law. A consequential direction is sought to the 1st respondent to take necessary steps to grant recognition of the D.Ed college of the petitioner-society at Kurnool. By the interim order, in WPMP.No.18762 of 2011 dated 10.06.2011, this Court directed the 1st respondent to consider the petitioner's application for starting D.Ed course, in accordance with law, without reference to the State Government's policy dated 07.01.2009.
A writ of mandamus would, ordinarily, not be issued directing the 1st respondent to grant recognition, and the only direction which would, ordinarily, be granted is for the 1st respondent to consider the petitioner's application in accordance with law. Suffice it, therefore, to make the interim order passed in WPMP.No.18762 of 2011 dated 10.06.2011 the final order in the writ petition. The Writ Petition is, accordingly, disposed of. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
