THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 22428 of 2016 ORDER :

The present Writ Petition came to be filed seeking to issue a writ of mandamus declaring the action of respondent No.3 in not proceeding with the investigation into crime No.41 of 2016 of Nidmanoor police station, Nalgonda District, though it was registered on 25.02.2016, as illegal and arbitrary.

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Telangana appearing for the respondents. At the request of both the counsel, the Writ Petition is being taken up for disposal at the stage of admission.

3. It is the grievance of the petitioner that though respondent No.3 registered a case in crime No.41 of 2016 of Nidmanoor police station, Nalgonda District for the offence punishable under Section 306 of the Indian Penal Code, 1860, on 25.02.2016, there is no progress in the investigation till date. The same is disputed by the learned Assistant Government Pleader stating that the police are investigating the matter and as the crime was registered in the month of February, 2016 only, it may take

some time for completion of investigation.

4. Having regard to the circumstances of the case and taking into consideration the nature of allegations made in the report, this Court is not inclined to fix a time frame for filing the final report. However, respondent No.3 is directed to complete investigation in the aforesaid crime and file a final report, in accordance with law, as early as possible.

5. The Writ Petition is disposed of with the aforesaid direction. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
