THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI Writ Petition No.208 of 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief/ s:

"to issue a Writ, Order or Direction, more particularly one in the nature of the Writ of Mandamus, declaring the questioning the action of the Respondent Nos.2 to 4 in entering into agreement with Respondent Nos.7 to 13 and trying to confer the benefits, without adjudicating the dispute as per Section 50 of the Andhra Pradesh Capital Region Development Authority Act, 2014 (Act No.11 of 2014) R/ w., Rule 8 of the Andhra Pradesh Capital City Land Pooling Scheme (Formulation and Implementation) Rules, 2015 and in spite of the pendency of the suit and Injunction therein vide O.S.No.181 of 2016 on the file of the II Additional District Judge, Guntur and representations dated 14.06.2016, 18.07.2016, 08.08.2016 and 19.10.2016 submitted by the Petitioner, in respect of lands totally admeasuring Ac.15.26 cents situated in Sy.Nos.

427, 3-1 & 3-2, 4-1, 40-D and 65-B & 66-D of Kuragallu Revenue Limits, Neerukonda Village, H/ o.Kuragallu, Mangalagiri Mandal, Guntur District and Sy.No.47-5 of Inavolu Village, Thulluru Mandal, Guntur District, as illegal, contrary to law, contrary to Section 50 of the Andhra Pradesh Capital Region Development Authority Act, 2014 (Act No.11 of 2014) R/ w., Rule 8 of the Andhra Pradesh Capital City Land Pooling Scheme (Formulation and Implementation) Rules, 2015 violative of principles of natural justice and Articles 14, 19(g) and 300-A of the Constitution of India and consequently direct the respondent Nos.2 to 4 to conduct enquiry and pass appropriate orders on the Petitioner's representations dated 14.06.2016, 18.07.2016, 08.08.2016 and 19.10.

I have heard the submissions of the learned counsel for the petitioner, learned counsel for the respondents 7, 8 & 10, learned counsel for respondent no.12, and of Sri M. Shiva Kumar, learned counsel representing Sri D. Ramesh, learned standing counsel for the 2nd respondent. I have perused the material record.

At the hearing, learned counsel appearing for the parties aforestated submitted as follows: 'The lis [O.S.No.181 of 2016, on the file of the Court of the learned II Additional District Judge, Guntur] between the petitioner and the unofficial respondents (R7 to R13) is compromised. The compromise terms are reported in Lok Adalat Case No.1244 of 2017; and, the Lok Adalat passed an Award, dated 28.07.2017, as per the terms of the compromise between the parties. The said Award of the Lok Adalat is placed on record. In view of the said Award, this writ petition may be disposed of directing the respondents 2 to 4 to confer the benefits like grant of ownership certificates and also payment of remunerations in terms of the compromise as are evident from the Lok Adalat Award and as per the respective entitlement of the petitioner and the unofficial respondents 7 to 13. '

Recording the afore-said submissions, the Writ Petition is disposed of in terms of the Lok Aalat Award afore-stated; and, the respondents 2 to 4 are directed to confer the benefits like grant of ownership certificates and also payment of remunerations to the petitioner as well as the unofficial respondents 7 to 13 in terms of the compromise as is evident from the Lok Aalat Award and as per their respective entitlements. Registry is directed to annex a copy of the Lok Adalat Award, dated 28.07.2017, in Lok Adalat Case No.1244 of 2017 to this order. There shall be no order as to costs.
