HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.1326 OF 2017 ORDER:

The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973, challenging the docket order, dated 08.11.2016, passed by the learned Judicial Magistrate of First Class, Peddapalli, by recording that "Accused present. For examination call on 30.05.2017" in C.C.No.82 of 2015.

Smt. Vankina Allu, learned counsel for the petitioner, would submit that the learned Magistrate has been adjourning the matter giving long duration and her submission is to direct the learned Magistrate to take up the examination on 30.05.2017. 3.

So far as the request is concerned, the volume of the work of the learned Magistrate is not known and no indication is given by the learned counsel for the petitioner or by the learned Additional Public Prosecutor for the State of Andhra Pradesh.

Be that as it may, since the calendar case is of the year 2015, it is obvious that the learned Magistrate may take up the matter on 30.05.2017 for examination as proposed by him. The petitioner filed the docket order of the Court below. In case, if any, inconvenience occasions on that particularly day, the learned Magistrate would take up the matter within reasonable time for examination of the accused.

With the above observation, the criminal petition is disposed of. 6.

Miscellaneous applications, if any pending in this criminal petition, stand closed.
