THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 21038 of 2019 O R D E R:

This Writ Petition is filed for the following relief: ".....to issue appropriate writ, direction or order more particularly one in the nature of writ of mandamus or any other writ or order/direction to the respondents not to infringe petitioners forests rights as provided the Schedule Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act 2006 more specifically not to infringe petitioners right to hold and live in the forest land under the individual or common occupation for habitation or for self cultivation for lively hood in forest ranges of Cherukupalli Village, Kistaram Gram Panchayat, Sathupalli Mandal, Khammam, Telangana...."

It is submitted by the learned counsel for the petitioners and the learned Government Pleader for Forests for respondent Nos.2 and 4 that the issue raised in the present Writ Petition is squarely covered by the order dated 20.09.2019 passed by this Court in Writ Petition No.19452 of 2019.

Relevant portion of the aforesaid order reads as under: "In those circumstances, the respondent authorities shall issue notice to the petitioners in accordance with the applicable law and take necessary steps to evict them or any other persons, who are in occupation of the forest land, duly following the procedure prescribed. Till such time, the petitioners shall not be evicted from the subject forest land. With the above directions, this Writ Petition is disposed of."

Following the aforesaid order and for the reasons stated therein, this Writ Petition is also disposed of in terms thereof.
