THE HONOURABLE SRI JUSTICE T.VINOD KUMAR W.P.No.21085 of 2019 ORDER:

This writ petition is filed questioning the action of the respondents 3 and 4 in interfering with civil disputes between the petitioner with the respondents 5 and 7 and harassing the petitioner by calling to the Police Station.

Learned Assistant Government Pleader for Home, based on the written instructions dated 24.09.2019 of Assistant Sub-Inspector of Police, Yadagirigutta Police Station, submitted that the allegations made by the petitioner that the 3rd and 4th respondents are interfering with civil disputes is false and denied and the said respondents never interfered with the civil disputes of the petitioner at any point of time. Further, it is also submitted that based on the complaint of one Mallesh, a case was registered in Crime No.247 of 2108 under Section 406, 420, 506 IPC of Yadagirigutta Police Station on 12.08.2018 against the petitioner and others. In the said case, the petitioner was arrayed as the first accused and during the course of investigation, the Investigating Officer tried to serve notice under Section 41(A) Cr.P.C. to the accused persons, but the accused instead of taking notice, filed the present writ petition with false and frivolous allegations to escape from the case.

In that view of the matter, recording the said submission of the learned Assistant Government Pleader for Home, this Writ Petition is dismissed leaving it open to the petitioner to avail an appropriate remedy, in accordance with law. There shall be no order as to costs.

As a sequel, miscellaneous applications, if any pending, shall stand closed.
