THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 20998 of 2019 ORDER:

This Writ Petition is filed for the following relief: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate writ, order or direction particularly one in the nature of writ of Mandamus, declaring the action of the 2nd respondent in refusing to give permission in Lr.No.3/C21/15576/2019 dated 14.09.2019 for proposals for construction of building in Plot No.B-IV/182 in Survey No.44/4, Maqta Mahaboobpet Village, Serilingampally Mandal, Ranga Reddy District, for being illegal, arbitrary, violative of provisions of GHMC Act, discriminatory and unconstitutional and consequently direct the 2nd respondent to forthwith accept the application of the petitioner and grant permission for construction of building, in Plot No.B-IV/182, in Sy.No.44/4, Maqta Mahaboobpet village, Serilingampally Mandal, Ranga Reddy District, without insisting on NOC from Revenue Department.."

When the matter is taken up, it is submitted by the learned counsel for the petitioner that the issue in the present Writ Petition is squarely covered by the order dated 22.03.2013 passed by this Court in Writ Petition No.8697 of 2013. Learned Standing Counsel for Greater Hyderabad Municipal Corporation appearing for the second respondent does not dispute the aforesaid submission.

CKR, J W.P.No.20998 of 2019 In those circumstances, following the above said order and for the reasons recorded therein, this Writ Petition is also disposed of in terms thereof. Further, the respondents are directed to receive and consider the petitioner's application for grant of building construction permission without insisting upon him to produce a 'No Objection Certificate' from the revenue department. It is made clear that the petitioner shall comply with all other requirements prescribed in law.

Office to annex a copy of the order dated 22.03.2013 passed by this Court in Writ Petition No.8697 of 2013 to this order.

Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
