Heard Sri Ch.Dhanamjaya, counsel for petitioners, Government Pleader for Revenue and Smt.A.Jayanthi, counsel for respondent Nos.4 and 5.
The petitioners pray for the following relief: ".....to issue writ of mandamus or any appropriate writ, order or direction declaring the action of the respondents and their subordinates in trying to dispossess the petitioners herein from their lawful and rightful possession of the land i.e., the land an extent of Ac.0.17 cents and 122 links, in respect of plots bearing No.11, an extent of 213.33 square yards, plot No.12 an extent of 204.44 square yards, plot No.13, an extent of 200 square yards and plot No.14, an extent of 200 square yards, totaling to 818 square yards of "Shri Shirdi Sainathapuram" out of Acs.8.25 cents covered by old Sy.No.498 and new Sy.No.538 out of total extent of Acs.16.50 cents 600 square yards; of the 1st petitioner and the land an extent of 600 yards in respect of plot No.40 an extent of 200 yards; plot No.
35 an extent of 200 square yards, plot No.34 and extent of 100 square yards on north side; plot No.41 an extent of 100 square yards on north side of Shri Shirdi Sainadhapuram, situated in old Sy.No.498 and new Sy.No.538 of Pothuru Village, Obulanaidupalem Panchayat area, Guntur, Guntur District of the 2nd petitioner, without following due process of law, as illegal, arbitrary and violative of principles of natural justice".
The counsel for petitioners places on record, the order of this Court, dated 07.08.2013 in W.P.No.15454 of 2013 filed by one V.Subbayamma, W/o Nageswara Rao, the predecessor in interest of petitioners, questioning order No.412 of 2007, dated 23.04.2007 passed resuming petition land from V.Subbayyamma. The present subject matter covers a portion of the land covered by proceedings dated 23.04.2007 impugned in W.P.No.15454 of 2013.
In view of the fact that the case of the petitioners is traced through V.Subbayamma, the petitioners pray for ordering the writ petition by following the order of this Court in W.P.No.15454 of 2013. I have perused the order dated 07.08.2013 in W.P.No.15454 of 2013.
The Writ Petition is disposed of by following the order of this Court dated 07.08.2013 in W.P.No.15454 of 2013 and secondly, respondents are directed not to interfere with the possession and enjoyment of the petition land except in accordance with law. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
