THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.21021 of 2019 ORDER:

This writ petition is filed declaring the action of respondent No.3-Station House Officer, Banjara Hills Police Station, Hyderabad, in calling the first petitioner to the police station on daily basis at the instigation of respondents 4 to 6, as illegal and arbitrary.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4.

The grievance of the petitioners is that the first petitioner is being called by respondent No.3 to the Banjara Hills Police Station on daily basis at the instigation of respondents 4 to 6 without there being any reason and consequently seeking a direction to respondent No.3 not to harass the petitioners without following due process of law. On written instructions, the learned Assistant Government Pleader for Home submitted that based on the complaint made by respondent No.4 on 24.09.2019 relating to the alleged incident on 13.09.2019, Crime No.865 of 2019 has been registered for the offences punishable under Sections 341, 323 and 506 read with Section 34 of the Indian Penal Code, 1860 against the petitioners herein.

He further submitted that the first petitioner was involved in Crime No.103 of 2019 for the offences punishable under Sections 448, 427, 324 read with Section 34 IPC and in connection with the investigation of said crime only she was being called to the Police Station. He also submitted that the investigation in the said crime is completed and charge sheet is also filed before the III Additional Chief Metropolitan Magistrate at Hyderabad, vide CC No.7021 of 2019 and it is pending for trial.

The learned Assistant Government Pleader for Home further submitted that it is only in connection with the investigation of said C.C.No.7021 of 2019 wherein the first petitioner is involved and in order to coerce, the present writ petition is filed.

It appears that there are inter se disputes of civil in nature between the petitioners and respondents 4 to 6. Since there are civil disputes between the parties, respondent No.3 herein is directed not to interfere with the civil disputes between the parties except in accordance with law.

With the above observation and direction, the writ petition is disposed of. However, there shall be no order as to costs.

As a sequel thereto, Miscellaneous Applications, if any, pending in this writ petition shall stand closed. ___________________ T. VINOD KUMAR, J Date: 27.09.2019 Isn
