Heard the learned counsel for the petitioner. 2.

The prayer sought in the Writ Petition is as under: "...to issue appropriate Writ, direction, or order more particularly one in the nature of Writ of Mandamus or any other Writ or order/direction of a like nature declaring the prescribing of a condition of successful candidate being within "top 20 percentile of successful candidates in Class XII examination conducted by the respective boards in applicable categories" by the Respondent No. 1 to 5 for admission into IIT's as arbitrary, unreasonable, unjust, unfair, discriminatory, biased and in violation of the petitioner's fundamental rights guaranteed by Article 14 and 21 of the Constitution of India and to direct the Respondents to admit the petitioner into the B.Tech course of Computer Science and Engineering offered by the Respondent No.

4 based on his preference and ranking in JEE (Advance)-2013 and declare the action of the Respondent No.

& 21 of the Constitution of India and to direct the Respondent No.3 to 5 to admit the petitioner into the B.Tech Courses into the IIT based on his rank in JEE (Advanced)-2013."

Learned counsel appearing for respondent No.2 would submit that in the light of the order sought in the Writ Petition, no further cause would survive in the present Writ Petition and hence, the Writ Petition has become infructuous. 4.

Taking into consideration the said submission, the Writ Petition is dismissed as infructuous.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
