THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT PETITION No.11085 OF 2001 ORDER:

The petitioner, who is a Lecturer in Economics, filed this writ petition aggrieved by the action of the 1st respondent in retaining the 5th respondent in the 3rd respondent-College, as illegal and consequently to direct the respondents 1, 3 and 4 to retain the petitioner in the 3rd respondent-College by not declaring him as surplus.

The 1st respondent passed the impugned order dated 31.08.2000, repatriating the 5th respondent from the 3rd respondent-College to the parent institution-2nd respondent.

Though a request was made by the 3rd respondent to retain the 5th respondent till the end of the academic year, the 1st respondent passed orders on 09.01.2001 requesting the 3rd respondent to relive the 5th respondent immediately. Therefore, the 3rd respondent by order dated 26.05.2001, relieved the 5th respondent to join duty in the 2nd respondent-College, duly intimating the same to the 1st respondent.

This Court, while admitting the writ petition on 26.08.2002, no interim orders were passed. The writ petition is filed in the year 2001. This Court felt that at the length of time, nothing survives for adjudication.

Accordingly, the Writ Petition is dismissed as infructuous. No order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
