THE HON'BLE DR JUSTICE SHAMEEM AKTHER SECOND APPEAL No. 1124 OF 2000 JUDGMENT:

Sri Viswanath Manoj, advocate representing Sri T.S.Anand, learned counsel for the appellant would submit that the appellant vacated the suit schedule premises long back and possession was delivered to the decree holder, and hence, the cause in the Second Appeal does not survive, rendering it infructuous.

Under these circumstances and in view of the concurrent findings of both the courts below, no substantial question of law would arise for consideration in the Second Appeal as pleaded in the grounds of appeal.

Accordingly, Second Appeal is dismissed. No costs. Miscellaneous Petitions pending, if any, in the Second Appeal shall stand closed.
