THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18776 OF 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking the following relief: " ... to issue an appropriate writ, order or direction more in the nature of Mandamus, declaring the action of the 2nd respondent in interfering with the rights of the petitioner at the instance of the 3rd respondent yielding to the pressures brought out by him through his political identities by not permitting the petitioner to enjoy her lands to an extent of Ac.1.30 guntas in Sy.no.818, to an extent of Ac.2-36 gts. In Sy.no.819/E, and Ac.2-08 gts. In Sy.no.819/EE1 of Manganoor village, Bijinepally Mandal, Nagar Kurnool District, and trying to settle the civil dispute even though the petitioner has obtained an injunction, he do not have any authority, as being illegal, arbitrary ...."
Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Home. With their consent, the Writ Petition is disposed of at the stage of admission itself. Since this Court is not going into the merits of the case, there is no necessity to issue notice to unofficial respondent.
Though various grounds are raised in the writ petition, the learned counsel for the petitioner restricts his prayer seeking a direction to the 2nd respondent not to interfere with the civil disputes pending between the petitioner and the 3rd respondent. Though no counter is filed, the learned Assistant Government Pleader, on instructions, submits that the allegations made in the Writ Petition are false. He further submits that a case in crime No.115 of 2017 of Bijinepally Police Station came to be registered
against the petitioner for the offence punishable under Sections 447, 504 and 506 of Indian Penal Code. Further, he denied the allegation that the 2nd respondent is calling the petitioner to Police Station at the instance of 3rd respondent.
Having regard to the rival submissions made, the Writ Petition is disposed of directing the respondent-Police not to interfere with the civil disputes, which are pending between the petitioner and the 3rd respondent. However, if the respondent-Police intend to take any action pursuant to registration of crime No.115 of 2017 against the petitioner, the same shall be in accordance with law. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
