CVNR,J & TA,J C.M.A.No.600 of 2018 JUDGMENT: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This civil miscellaneous appeal is filed against order and decree, dated 21.04.2018 in G.W.O.P.No.1150 of 2011 on the file of the learned Principal District Judge, West Godavari at Eluru.

I.A.No.2 of 2018 is filed by the appellant with the prayer that in view of memorandum of understanding, dated 19.11.2018, C.M.A.No.600 of 2018 may be allowed. Along with this application, the said memorandum of understanding is filed. Clause 6 of the memorandum of understanding, which is relevant for disposal of the present case, reads as under.

"6. That both the parties undertake to withdraw their respective appeals filed before the High Court of Judicature at Hyderabad challenging the orders passed in G.W.O.P.No.1150 of 2011 on the file of Principal District Judge, Eluru.

In furtherance of the same, the Second Party would not insist for guardianship over the minor child Master Vaddy V.Suraj Kumar."

At the hearing, the learned counsel for the respondent has fairly conveyed no objection for allowing C.M.A.No.600

CVNR,J & TA,J C.M.A.No.600 of 2018 of 2018 in terms of memorandum of understanding, dated 19.11.2018.

Having regard to the facts noted above, order and decree, dated 21.04.2018 in G.W.O.P.No.1150 of 2011 on the file of the learned Principal District Judge, West Godavari at Eluru are set aside. I.A.No.2 of 2018 and C.M.A.No.600 of 2018 are, accordingly, allowed in terms of memorandum of understanding, dated 19.11.2018, which is filed along with I.A.No.2 of 2018.

As a sequel to allowing the C.M.A., I.A.No.1 of 2018 filed by the appellant for interim relief stands disposed of as infructuous.
