THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23861 OF 2005 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking to issue an order or direction more particularly, in the nature of writ of certiorari to declare the impugned order of suspension, dated 18.6.2005, passed by respondent No.1 for an indefinite period beyond the period of four months as illegal and arbitrary and consequently, to quash the said order.

It is evident from the record that on 10.2.2006, this Court granted interim suspension and directed the respondents to take the petitioner into service forthwith and later, on 27.9.2007, the said order was made absolute. Today, when the matter is called, learned Standing Counsel appearing for respondent Nos.1 and 2 submitted that as per the direction of this Court, the petitioner was already reinstated into service.

Recording the said submission, this Court is of the view that nothing survives for adjudication in this writ petition and therefore, the Writ Petition is liable to be dismissed as infructuous. 4.
Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
