HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.25781 OF 2016 ORDER:

The case of the petitioner is that his mother purchased the land admeasuring Ac.35-00 guntas in Sy.No.582/1/3 on 16.05.1968 and since then they have been in possession and enjoyment of the said land. After the death of his mother, the property of Ac.35-00 guntas fell into the share of the petitioner. While so, the respondent authorities are trying to occupy the petitioner's land in the name of Harithaharam programme as there is a forest land to the north and a pathway on the east and south sides of the petitioner's land. Against the same, the petitioner made representation dated 13.07.2016 requesting forest department authorities to fix the boundaries to the forest land. As no action has been initiated by the respondents for conducting survey and fixing boundaries, the present writ petition is filed.

Heard the learned counsel for the petitioner, learned Assistant Government Pleader for Revenue and the learned Assistant Government for Forests. The petitioner filed pattadar passbooks and registered partition deed issued by the revenue authorities to show that they are having title and have been in possession of the subject property.

In view of the same, the 2nd is directed to take a decision on the application filed by the petitioner for conducting joint survey in the presence of the forest officials and also the petitioner for fixing the boundaries of the forest land, after issuing notice to respondents 5 and 6. Till such time, status-quo obtaining as on today shall be maintained by both the parties. With the above direction, the writ petition is disposed of. No costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
