Notice of the third respondent dated 03.06.2016 and consequential notice dated 08.06.2016 is questioned in this Writ Petition.
By notice dated 03.06.2016, the third respondent informed the petitioner that she is in occupation of government land, admeasuring Ac.0.10 cents in Sy.No.117, Nelamuru Village, Penumantra Mandal, West Godavari District, abutting drainage canal, and directed to vacate within three days. A consequential notice dated 08.06.2016 was issued by the third respondent to the petitioner calling upon to build a bund within three days and handover the government land which is in her illegal occupation. While the petitioner admits to be in illegal occupation of the government land, admeasuring Ac.0.10 cents in Sy.No.
117, Nelamuru Village, but, however, would submit that directing to vacate her within three days is arbitrary and that the petitioner be granted reasonable time to make necessary arrangements to confine the activities in the land owned by her. Considering the submissions made by the petitioner, and in the light of the admitted facts of the case, the petitioner may be granted three months time to handover the alleged government land in her occupation. The petitioner shall also take necessary steps to construct bund and necessary engineering assistance, as may be required, shall be provided by the third respondent by demarcating the land.
The Writ Petition is, accordingly, disposed of.
Miscellaneous Petition pending, if any, shall also stand disposed of. However, in the circumstances, without costs.
