This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused No.4 in the event of his arrest in Crime No.191 of 2021 on the file of Station House Officer, Kulsumpura Police Station, Goshamahal Division, Hyderabad, registered for the offence punishable under Section 8(c) read with Section 20(b)(ii)(B) of NDPS Act-1985.

Heard learned counsel for petitioner/Accused No.4 and learned Assistant Public Prosecutor for respondent-State. Perused the record.

The allegation in the charge sheet is that Accused Nos.1 to 3 were found in possession of 1.5 kgs of ganja and as per the confession of Accused Nos.1 to 3 the said ganja was purchased from this petitioner/Accused No.4.

Learned counsel for the petitioner submits that the police completed the investigation and this petitioner is shown as absconding in the charge sheet filed by the Kulsumpura Police. 5.

In the said circumstances, this criminal petition is disposed off directing the petitioner/Accused No.4 to surrender before the I Additional Metropolitan Sessions Judge at Hyderabad in SC No.55 of 2022 on 18.07.2022 and on such surrender the I Additional Metropolitan Sessions Judge shall release the petitioner/Accused No.4 on bail on imposing certain conditions.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
