THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7535 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.5 in Crime No.189 of 2022, on the file of Kadthal Police Station, Cyberabad, registered for the offences under Sections 363, 376 (2) (i) (n), 109 of IPC and Section 5 r/w. Section 6 of the Protection of Children from Sexual Offences Act, 2012. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner is arrayed as A-5. The case of the prosecution is that A-1 had taken the victim girl who is a minor and married her. This petitioner allegedly supported the marriage of the victim girl and A-1 in Maisamma temple. Apart from the said allegation, there is no other allegation in the remand report.

Learned Additional Public Prosecutor would submit that the investigation is complete and charge sheet is already filed.

Keeping in view the allegation against this petitioner, this Court deems it appropriate to grant the relief of regular bail, subject to following conditions:

i) The petitioner/Accused No.5 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate at Amangal, Ranga Reddy District.

ii) The petitioner/Accused No.5 after release shall appear before the concerned Court on every date of hearing.

iii) The petitioner/Accused No.5 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
