THE COURT MADE THE FOLLOWING:

ORDER:

Granting of building permission in favour of respondent Nos.3 to 5 by respondent No.2 is questioned in this writ petition only on the ground that a civil suit pertaining to the title dispute is pending between the petitioner and respondent Nos.3 to 5. In my opinion, mere pendency of a civil suit would not deter respondent No.2 from granting building permission. If the petitioner so chooses, she can secure appropriate interim orders from the Civil Court in which the suit is pending restraining respondent Nos.3 to 5 from proceeding with the construction.

Subject to the liberty given to the petitioner as above, the writ petition is dismissed. As a sequel to dismissal of the writ petition, W.P.M.P. No.49705 of 2015 shall stand disposed of as infructuous.
