THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.78 OF 2014 ORDER:

1. This Criminal Petition is filed by the petitioners-accused Nos.3, 5 to 7 under Section 482 of Code of Criminal Procedure seeking to quash the proceedings against them in Crime No.152 of 2013 on the file of Rajupalem Police Station, Guntur District, registered for the offence punishable under Section 498-A IPC.

2. While ordering notice before admission, this Court granted interim stay of investigation in the above crime insofar as the petitioners-A3, A5 to A7 concerned.

3. It is brought to the notice of this Court that investigation was completed and charge sheet was filed insofar as A1 and A2 are concerned in the above crime and due to the order of stay in this petition, the investigation has not been completed insofar as the petitioners-A3, A5 to A7 are concerned.

4. Considering the facts and circumstances of the case and the nature of the allegations made against the petitioners, this Court is not inclined to grant the relief sought by the petitioners in this petition.

However, the 1st respondent-police are directed to complete the investigation without arresting the petitioners-A3, A5 to A7 and file a final report, if any, in accordance with law. The petitioners are also directed to appear before the Investigating Agency as and when required and cooperate with the Investigating Agency.

5. With the above directions, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
