Heard the learned counsel for the petitioners and the learned Government Pleaders for Revenue & Forest appearing for the respondents.
The petitioners claimed to be scheduled tribe community people. While so, on the representation of one Smt. Vooke Annapurna of Manchikantinagar Village, Aswapuram Mandal, Khammam District, a joint survey was directed to be conducted by the Sub-Collector, Palvancha by his communication dated 23.06.2015 addressed to the Tahsildar, Aswapuram Mandal and Forest Range Officer, Aswapuram. The petitioners belong to Jaggaram, Chandrabodu and Chintriyalagudem villages of Aswapuram Mandal. The said joint survey covers their villages also. The fourth respondent-Tahsildar, Aswapuram Mandal issued a notice on 27.06.2015 fixing the date on 01.07.2015 and though the petitioners went to the land on 01.07.2015, no such joint survey by forest and revenue officials was conducted. In those circumstances, the present writ petition is filed seeking a direction to the respondents 3 & 4 to complete the joint survey directed to be conducted by the Sub-Collector, Palvantha pursuant to the orders dated 23.06.2015.
In view of the above facts and circumstances of the case, the writ petition is disposed of directing the respondents 3 & 4 to complete the joint survey and furnish a copy of the report to the petitioners within a period of 30 days from the date of receipt of a copy of this order. It is needless to mention that the presence of the petitioners shall be ensured at the time of conducting the joint survey. Miscellaneous Petitions, if any pending in this writ petition shall stand closed. No order as to costs.
