THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.625 OF 2000 JUDGMENT:

This Second Appeal is filed under Section 100 of C.P.C., by the defendants, assailing the judgment and decree dated 28.04.1999 passed in A.S.No.41 of 1994 on the file of the Court of the Additional Senior Civil Judge, Gudur, wherein and whereby the judgment and decree dated 16.09.1994 passed in O.S.No.415 of 1987 on the file of the Court of the District Munsif, Gudur, was confirmed.

Learned counsel for the appellants submitted that in spite of sending of notice, there was no response from the appellants. Learned counsel for the respondent submitted that all the appellants died.

In view of the submission made by the learned counsel for both parties, no purpose will be served by keeping the matter pending.

Hence, the Second Appeal is dismissed. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Second Appeal shall stand closed.
