ORDER :
The petitioner is working as Conductor in the Respondent Corporation. By seeking that she has cervical spondylitis problem, petitioner requested for assigning desk work other than the work of Conductor. Accepting the said request, she was posted on out of duty basis. On completion of her one year, she was asked to report back to duty by notice dated 23.4.2019, which is impugned in this writ petition.

It is not in dispute that the petitioner is a Conductor and as a Conductor, she is required to discharge the duties attached to the said post and as a matter of fact on earlier occasion, as per the request of the petitioner, she was assigned with the work other than the work of Conductor for a period of one year. However, learned counsel for petitioner asserts that the petitioner is unwell and she may be posted on out of duty basis for one more year, so that she can get treatment for her disease and thereafter she will resume to the post of Conductor. Such a direction cannot be granted, particularly when the petitioner has not reported to duty after almost five months after the impugned notice was issued and no request was made for further continuation on out of duty basis. 3.
Therefore, the writ petition is disposed of, granting liberty to the petitioner to make an application for further continuation of her out of duty basis and on making such representation, it is for the respondent-competent authority to consider such request and take a decision, in accordance with law. As a sequel, the miscellaneous applications, if any, shall stand closed.
