HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31402 OF 2011 O R D E R :

This writ petition is filed for writ of mandamus declaring the action of the respondents 1 and 2 at the instance of respondent No.3 in selecting the site located on the south western side of petitioner's land to an extent of Ac.2-93 cents in R.S.No.73/1, 73/3, 73/4B of Dondapadu Village, Chodimella Gram Panchayat, Pedavegi Mandal, West Godavari District for the construction of public toilets or any such natured constructions blocking petitioner's easementary right of passage, as illegal and arbitrary.

Heard the learned counsel for the petitioner. Sri Ravi Cheemalapati, learned Standing counsel for the 1st respondent submits that as on today, there is no such proposal for construction of toilets.

Recording the said submission, the writ petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous petitions, pending, if any shall stand closed.
