This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking to enlarge him on bail in connection with Crime No.180 of 2025 on the file of Narsapur Police Station, Medak District. The offences alleged against the petitioner are punishable under Sections 64 (1), 137 (2) of the BNS Act and Section 3 and 4 of the POCSO Act.

The case of the prosecution is that the father of the victim lodged a report before police on 04.06.2026, wherein it is stated that his elder daughter got married and the victim completed her intermediate. On 03.06.2026 in the night around at 2:00 hours when he woke up for attending nature calls, he noticed that the victim was not present. They searched for her in the vicinity and relatives, but could not find her. It is stated that they have doubt on the villager by name Kaseerkadi Mahender.

While searching, it caused delay in lodging the report. Hence, he requested the police to take necessary action against the said complaint. Basing on the same, police registered a case for the aforesaid offences.

Heard Sri Akkam Eshwar, learned counsel for the petitioner/Accused and Sri D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondentState. 4.

The contention of learned counsel for the petitioner is that the petitioner is innocent of the offences alleged against him; that the petitioner is aged about 20 years that the petitioner and the victim are loving with each other and she voluntarily left with the petitioner.

Even according to the prosecution, earlier so the petitioner exploited the victim, but no case is registered against him; that the petitioner is in judicial custody since 13.06.2026; that entire investigation is completed including statement of victim under Section 183 of the BNSS Act, as such requested this Court to grant regular bail to the petitioner. 5.

On the other hand, learned Additional Public Prosecutor opposed the same and submits that the allegations levelled against the petitioner are heinous and grievous in nature and that as investigation is not yet completed, at this stage, the petitioner is not entitled for grant of bail and requested this Court to dismiss the petition.

Considering the submissions made by learned counsel for petitioner and learned Additional Public Prosecutor, the petitioner has been in judicial custody since 13.06.2026. As seen from the record the statements L.Ws.1 to 19 were examined. According to prosecution, statement of victim under Section 183 of BNSS was also recorded. Considering the nature of allegation and also period of incarceration and progress in investigation, this

Court deems it fit to grant bail to the petitioner/Accused subject to the following conditions:

(i) The petitioner-accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Narsapur, Medak District.

(ii) On such release, the petitioner-accused shall appear before the concerned S.H.O. between 09:00 a.m., and 5:00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The petitioner-accused shall abide by the conditions stipulated in Section 437 (3) of Cr.P.C. (presently, Section 480 (3) of BNSS). 7.

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
