HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.22470 OF 2002 ORDER:

This Writ Petition is filed seeking to issue a writ of mandamus, declaring the action of the respondents in preventing the petitioner to join duty from 1st July, 2002 and also illegally appointing 4th respondent as illegal and arbitrary and sought a consequential direction to reinstate the petitioner into service with all backwages.

Heard Mr.P.Ratnam, Counsel for the petitioner and the Government Pleader for Education.

It has been contended by the petitioner that he was initially appointed as Attender in the month of December, 1989. But the respondents are not considering his case for regular absorption in aided vacancy. It has been further submitted by the petitioner that the Commissioner for Intermediate Education has addressed a letter on 19.06.2003, asking the 3rd respondent to submit proposals, but so far, no decision is taken on the said letter issued by the Commissioner for Intermediate Education.

Having considered the submissions made by the parties, this Court is of the considered view that this Writ Petition can be disposed of, directing the petitioner to make a fresh representation within one week and upon such representation being received, the respondents shall consider and pass appropriate orders within a period of four weeks thereafter.

With this observation, Writ Petition is disposed of. 6.
