Sri Bankatlal Mandhani, learned counsel for the appellant, would submit that the matter was settled out of Court.

2. The sole respondent has filed a Memo, dated 09.06.2017, vide USR No.3762 of 2017, which is placed in the bundle. The said Memo is to the effect that the appellant has paid the entire due amount to the respondent and hence, the present Second Appeal may be dismissed.

3. In view of the Memo, dated 09.06.2017, as well as the submission made by the learned counsel for appellant, the present Second Appeal stands disposed of. The Memo, dated 09.06.2017, shall form part of the record.
