Sri.Anji Reddy N v. The State Of Telangana
THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.21015 of 2019 ORDER:
This writ petition is filed with the following prayer: "....to issue a writ, order or orders more particularly in the nature of Writ of Mandamus declaring the in-action of the 2nd Respondent-Election Authority to conduct elections to the 4th Respondent-Society as illegal, arbitrary, discriminatory, illegal and contrary to the Telangana Cooperative Societies Act and the rules framed there under and consequently direct the 2nd Respondent-Election Authority to initiate the election process where it was stopped forthwith and pass such other order or orders as this Hon'ble Court may deems fit just and proper in the circumstances of the case."
2.
Heard learned counsel for the petitioners and learned Government Pleader for Cooperation.
3.
Learned counsel for the petitioners submits that after issuing election notification, by citing the order of this Court in W.P.No.16337 of 2019, dated 02.08.2019, elections have been postponed, vide proceedings, dated 19.08.2019, though the objections, dated 12.07.2019, were considered and disposed of and the same were also communicated to one of the petitioners viz., V.Radha Krishna, vide letter, dated 16.07.2019. He further submits that having issued election notification, elections cannot be postponed. 4.
Learned Government Pleader for Cooperation submits that the objections have not yet been considered pursuant to the directions given by this Court in W.P.No.16337 of 2019. As soon as the
objections are disposed of, elections will be conducted and it takes some time.
5.
In this case, it is to be seen that W.P.No.16337 of 2019 is filed by one V. Radha Krishna and others stating that their objections have to be considered in accordance with law. In page No.23 of the material papers, the proceedings, dated 16.07.2019, would show that the objections/claims were considered and disposed of. But learned Government Pleader submits that objections are yet to be considered. 6.
In view of the facts and circumstances, if the objections are not considered, the concerned authority shall consider and dispose of the same. If the objections are considered, the same may be informed to the election authority.
7.
Accordingly, the writ petition is disposed of directing the respondents to consider the objections within a period of two weeks from the date of receipt of a copy of this order, if not already considered, and the same shall be informed to the election authority and the election authority shall complete the process of conducting elections within a period of two months from thereafter. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
