HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7134 of 2017 ORDER:

Heard learned counsel for petitioner/ accused in Crime No.66 of 2017 of Pedakurapadu Police Station, Guntur District, registered for the offences punishable under Sections 447, 427 and 509 IPC and also learned public prosecutor representing the respondent-State and perused the averments in the quash petition and contents of FIR.

2) This Court no way feels it just, for the reason that from the very reading of FIR, there is not even a little whisper to attract the offence under Section 509 IPC but for to retain the other penal Sections, nothing to interfere from the prima facie accusation.

3) Having regard to the above, the Criminal Petition is partly allowed quashing the offence under Section 509 IPC in the FIR and by retaining the other penal Sections 447 and 427 IPC. Further remedies of the petitioner are left open otherwise. 4) Pending miscellaneous petitions, if any, shall stand closed.
