THE HON'BLE SRI JUSTICE D.V.S.S.SOMAYAJULU C.R.P.No.3283 of 2018 ORDER:

This Civil Revision Petition is filed questioning the order dated 22.01.2018 in I.A.No.590 of 2017 in HMOP.No.11 of 2013 on the file of Senior Civil Judge, Bobbili.

This Court has heard both the counsel.

Sri K.Sitaram, learned counsel for the revision petitioner pointed out that the Court which is not satisfied with the reasons for the delay ultimately took a sympathetic view and condoned the delay, since it is a matrimonial case. The application was allowed on costs of Rs.100/-. Questioning this order, the revision is filed. No stay was granted by the Court pending revision and as per the learned counsel, cross examination of witnesses was also commenced. In view of the fact that cross examination has already been commenced, this Court is of the view that the Civil Revision Petition need not be kept pending.
