THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 17187 of 2016 ORDER :

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Mines and Geology for the State of Andhra Pradesh representing the respondents.

2. This Writ Petition is filed seeking to declare the inaction of respondents in granting permission to decast the sand deposited in the lands belonging to petitioners in an extent of Ac.43.95 cents situated in survey No.552/6/A and 552/5B of Dharanikota Village, Amaravathi Mandal, Guntur District as illegal and arbitrary.

3. Though various grounds are raised in the Writ Petition, learned counsel for the petitioner restricts his prayer seeking a direction to the authorities to dispose of representation dated 04.06.2016 made by the petitioners (made after filing of the present Writ Petition) to respondent No.3 for decasting and transportation of the sand to the needy public, at the earliest. Learned Assistant Government Pleader submits that report of the Tahsildar has already been called for and as soon as the report is received, the authorities will pass appropriate

orders on the representation.

4. As seen from the the representation dated 04.06.2016, the same was made to respondent No.3-Joint Collector, by speed post. It is said that respondent No.5 is the appropriate authority to consider the representation of the petitioner. Having regard to the submissions made, the petitioner shall make a fresh representation to fifth respondent, in the event of which the respondent No.5 viz. the Assistant Director of Mines and Geology, Guntur, shall consider the same and pass appropriate orders on the said representation in accordance with law as early as possible preferably within a period of 8 weeks from the date of receipt of the said representation.

5. The Writ Petition is disposed of with the aforesaid direction. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
