THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION NO.26129 OF 2005 ORDER:
The petitioners, who claim to be the residents in Sy.No.844/1 of Ramanjaneya Nagar Slum, Malkajgiri Mandal, Ranga Reddy District, filed this writ petition seeking a direction to the respondents not to interfere with their peaceful possession over their properties.

It is stated in the writ affidavit that the respondents have issued patta certificates to the petitioners in Sy.No.844/1 and allotted another piece of land to Wesley High School Society for construction of residential houses for the staff in Sy.No.844/23. It is also stated that in view of the confusion about the identification of the lands, there was a threat of eviction of the petitioners from their properties.

This third respondent filed a counter-affidavit stating that Wesley Girls High School and Junior College Employees Co-operative Housing Society were allotted an extent of land admeasuring Ac.4-09 guntas in Sy.No.844/23 of Malkajgiri Village and that they are not trying to dispossess the petitioners from their properties. It is also stated that the property claimed by the petitioners was the subject matter of LGC.No.64 of 1994, wherein the Special Court under A.P. Land Grabbing (Prohibition) Act, at Hyderabad in its judgment, dated 20.07.2000, held that the petitioners are land grabbers.

Since a clarification has been given by the respondents that they are not interfering with the petitioners' properties, this writ petition is disposed of directing the respondents not to interfere with the properties of the petitioners, except in accordance with law, after giving them reasonable opportunity.
