THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY I.A.Nos. 2 AND 1 OF 2018 IN/AND CRIMINAL PETITION NO. 9013 OF 2014 COMMON ORDER:

While I.A.No. 2 is filed under Section 320 (6) of Cr.P.C. seeking permission of the Court to compound, I.A.No. 1 is filed under Section 320 (2) of Cr.P.C. to record compromise in C.C.No. 52 of 2014 on the file of the Court of learned XV Additional Chief Metropolitan Magistrate at Nampally, Hyderabad, registered for the offence punishable under Section 498-A of IPC.

Both parties are personally present and they are identified by their respective counsel and produced Photostat copies of Aadhaar Cards in proof of their identity. On enquiry, they have stated that the marriage between the applicant and respondent No. 1 was annulled by competent Court; that there is no subsisting marital relationship between them; that they intend to lead peaceful live at least in future and that therefore they have entered into compromise and the compromise is voluntary in the interest of both parties and not against the societal interest.

In the light of the above, I.A.Nos. 1 and 2 are allowed permitting both parties to compound the said offence and to record compromise.

In view of the orders passed in I.A.Nos. 1 and 2 of 2018, this Criminal Petition is allowed quashing the proceedings in C.C.No. 52 of 2014 on the file of the Court of learned XV Additional Chief Metropolitan Magistrate at Nampally, Hyderabad. Pending miscellaneous petitions, if any, shall stand closed in consequence.
