THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3235 OF 2017 O R D E R :

This Writ Petition is filed questioning the inaction on the part of the 2nd respondent Joint Director-cum-Appellate Commissioner on the Appeal said to have been preferred by the petitioner on 18.03.2016 challenging the Order of the 3rd respondent Chilakaluripet Municipality dated 31.12.2011. Heard learned counsel for the petitioner.

Sri Nimmagadda Venkateswarlu, learned Standing Counsel for the 3rd respondent Municipality submits that against the Order dated 31.12.2011, the Appeal ought to have been preferred within 30 days, but, in the present case, since it was filed on 18.03.2016, much after 31.12.2011, the same could not be entertained. He further submits that, what the petitioner claims to have filed is not an Appeal and it is, in fact, a representation. Having considered the submissions made by the learned Standing Counsel, as it is the bounden duty of the 2nd respondent being an Appellate Authority to make an order on the Appeal / representation, the Writ Petition is disposed of directing him to pass an appropriate order on the Appeal / representation filed by the petitioner on 18.03.2016, on merits, within two weeks from the date of receipt of a copy of this order. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
