THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.4821 of 2012 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking the following relief/s:- "....to issue an order, direction or a Writ, one in the nature of Writ of Mandamus declaring the action of the respondents in constructing /laying a R.C.C.Road, between the Eastern Gate and the Rangeel Darwaza and other internal roads belonging to Sri Sitaram Maharaj Samsthan, Sitarambagh, Hyderabad as illegal and high-handed and pass such other order or orders deemed fit and proper in the circumstances of the case.

2. As per the submissions, the writ petitioner does not want the GHMC to construct or lay the RCC road between the Eastern gate and the Rangeel Darwaza and also other internal roads in the premises of Sri Sitaram Maharaj Samsthan, Sitarambagh, Hyderabad.
3 . When this writ petition came up for hearing on 24.02.2012, the then learned Standing Counsel for GHMC, having taken notice, had stated that in the event Sri Sitharam Maharaj Samsthan, Sitarambagh, Hyderabad is not interested in the laying of a CC road over the existing pathway leading to the temple, the GHMC will drop the proposal.
4. The learned counsel for the writ petitioner would submit that if the GHMC drops the proposal to lay the proposed road, the writ petitioner has no grievance and the writ petition may be closed recording the said submission, which was made earlier by the then learned Standing Counsel for the GHMC.
5. Sri N.Ashok Kumar, the present learned Standing Counsel for the GHMC also endorses the view of the learned counsel for the writ petitioner and submits that recording the submission made earlier by the then learned Standing Counsel for GHMC the writ petition may be disposed of as no cause survives for adjudication and that such a course would sub-serve the ends of justice.
6. Recording the said submissions of the learned counsel for both the sides, this writ petition is closed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ______________________ M.Seetharama Murti, J 27th January, 2016 Bvv
