AND THE HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.32116 of 2015 PC:(Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the petitioner and learned Government Pleader for Irrigation for the respondents.

The petitioner, in the instant writ petition, takes exception to G.O. Ms. No. 102, dated 23.9.2015, issued by the State of Andhra Pradesh insofar as appointing the 4th respondent as President of Water Users Association, Yeleru Reservoir Project (Major), Somavaram Village, Kirlampudi Mandal, East Godavari District, and declare the same as illegal, arbitrary, high handed and so also in violation of the procedure contemplated in G.O. Rt. No.528, dated 13.8.2015.

We have heard learned counsel for the petitioner and perused the entire material placed before the Court.

It appears that vide G.O. Ms. No.102, dated 23.9.2015, not only President and Vice President, but four other members of the Managing Committee were also appointed. We do not find any reason why the petitioner is selective in challenging only the appointment of President, on the grounds, which apply to the entire Managing Committee, constituted vide G.O. Ms. No.102, dated 23.9.2015. That apart, it also appears that the appointment of President, Vice President and four members of the Committee is by way of stop gap arrangement, i.e., till the Managing Committee of the Water Users Association is elected.

In the circumstances, we find no merit in the writ petition. The writ petition is dismissed.

We hope and trust that the steps for constitution of the Managing Committee will be taken expeditiously.

Consequently, pending miscellaneous applications shall also stand closed.
