THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7680 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners-Accused No.1 and 2 seeking anticipatory bail in the event of their arrest in connection with Crime.No.190 of 2023 on the file of Dharmapuri Police Station, registered for the offence under Section 307 and read with 34 of the Indian Penal Code, 1860.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondentState and perused the record. 3.
A complaint was filed before Dharmapuri Police Station on 09.07.2023 alleging that the petitioner No.1, who is the father-in-law of the victim and petitioner No.2, who is her relative, attacked the victim for the reason of harassing petitioner No.1 daughter, who is the wife of victim.

Learned Additional Public Prosecutor on instructions would submit that, simple injuries were received by the victim.

Keeping in view, that there was altercation regarding family disputes which arose in between the victim, who is son-in-law of accused No.1 and his wife, who is the daughter of accused No.1, this Court deems it appropriate to grant relief of anticipatory bail subject to the following conditions:-
1) The petitioner/Accused No.1 and 2 are directed to surrender before the Station House Officer, Dharmapuri Police Station, Jagtial District.
Upon such surrender, the said Station House Officer shall release the petitioners/Accused No.1 and No.2 on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioners/Accused No.1 and No.2 shall appear before the concerned police on every Monday for a period of (04) weeks at 10.00 a.m. and thereafter, as and when required for the purpose of investigation.
3) The petitioners/Accused No.1 and No.2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
