HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 8474 of 2011 ORDER:

Heard learned counsel for the petitioner and Government Pleader for Social Welfare.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not considering the case of the petitioner for appointment as Junior Assistant in the fourth respondent institution on contract basis for a period of five years on consolidated salary, as illegal, arbitrary and violative of Articles 14, 16 and 21 of the Constitution of India; and consequently direct the respondents to continue the petitioner as Junior Assistant on contract basis for a period of five years on consolidated salary.

Issue identical to the case on hand came up for consideration before this Court in W.P.No.11075 of 2000 wherein a Division Bench of this court held as under:

"The matter is covered by a Division Bench decision of this Court in Secretary, A.P. Social Welfare Residential Educational Institutions Society v. P.Venkata Kumari, this writ petition is disposed of with a direction that the cases of the petitioners be considered strictly in terms of G.O.Ms.No.212, Finance and Planning (FW.PC.III) Department, dated 22.04.1994 and other relevant Government Orders and Circulars, in the light of the aforementioned decision.".

In view of the judgments referred to above, the writ petition is disposed of with a direction to consider the case of the petitioner in terms of G.O.Ms.No.212 Finance and Planning (FW.PC.III) Department, dated 22.04.1994 and other relevant Government Orders and Circulars. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
