THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.17949 of 2014 ORDER:

This writ petition is filed under Article 226 of the Constitution of India, with the following relief:

"To issue a Writ, order or direction, more particularly one in the nature of a Writ of Mandamus to declare the action of respondents 1 to 5 in accepting the nomination of sixth respondent and declaring her elected as MPTC of Torrur Village, Hayatnagar Mandal, Ranga Reddy District despite disqualification incurred under Section 19(3) of A.P. Panchayat Raj Act, 1994 as arbitrary, illegal and set aside the same". 2.

As per the provisions of Section 22 read with Section 156 of Telangana State Panchayat Raj Act, 1994 (for short 'the Act') disqualification under the provisions of Section 19(3) of the Act can be agitated as per the procedure contemplated under Section 22 of the Act. In view of the said alternative remedy available to the petitioner, this Court is not inclined to entertain the present writ petition. However, it is open for the petitioner to avail the said alternative remedy, if she is advised to do so, in accordance with law.

Accordingly, the writ petition is closed. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date: 22.3.2017 DA
