19.09.2025 JSR, J Transferred to i/o folder, before corrections, if any I.A.No.2 of 2025 This application is filed seeking relaxation of condition No.(ii) imposed by this Court in Crl.P.No.8604 of 2025 dated 18.07.2025 while granting bail to the petitioner/accused No.3. Heard Mr.Syed Zain Ul Abiden Bin Taher, learned counsel for the petitioner, and Mr. M. Vivekananda Reddy, learned Assistant Public Prosecutor appearing for the respondent State.

Learned counsel for the petitioner submits that pursuant to the order dated 18.07.2025 passed in Crl.P.No.8604 of 2025, the petitioner has been appearing before the S.H.O., Nallakunta Police Station, on every Monday at 11.00 a.m. He further submits that the petitioner has to travel a long distance from Chennai to Hyderabad to comply with condition No.(ii) and the parents of the petitioner are suffering from old age ailments and his presence is very much required to take care of them. Unless condition No.(ii) is relaxed, the petitioner will be put to great hardship.

Learned Assistant Public Prosecutor has not opposed the same.

Taking into the consideration the facts and circumstances of the case and in view of the reasons assigned in the affidavit filed in support of the application, condition No.(ii), imposed by this Court in Crl.P.No.8604 of 2025 dated 18.07.2025, is hereby relaxed and the other conditions remain unaltered except above.

Accordingly, I.A.No.2 of 2025 is ordered.

Having considered the rival submissions of the respective parties and taking into consideration the submissions made by the learned Government Pleader for Land Acquisition, respondent No.3 has already referred the application/representation dated 23.09.2024 submitted by the petitioner under Section 3G (5) of the Act to respondent No.2 and the proceedings are pending before respondent No.2. In view of the same, respondent No.2 is directed to consider the application/representation dated 23.09.2024 submitted by the petitioner invoking the provisions under Section 3G (5) of the Act and pass appropriate orders in accordance with law, within a period of four (4) months from the date of receipt of copy of this order, after issuing of notice to the petitioner and any other affected parties. Respondent No.2 is directed to conclude the said proceedings/orders preferably within a period of five (5) months from the date of receipt of a copy of this order. Issue C.C. in a week.
