HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 4874 of 2004 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not regularizing the services of the petitioner from the date of initial appointment in the post of Shramik (Cleaner) in the backlog vacancies of S.T. community in Vizianagaram Region, as illegal and arbitrary. Learned counsel for the petitioner submits that the petitioner was appointed after undergoing regular selection process on 12.06.2000 in pursuance to a notification issued for filling up the backlog vacancies. The grievance of the petitioner is that the services of the petitioners are not yet regularized from the date of his initial appointment, though the respondents have regularized the services of similarly situated persons from the date of their initial appointment. He further contends that though the petitioner has submitted a representation to the respondents on 18.01.2004 seeking regularization of his services, the same is still pending consideration. Learned standing counsel for the respondents has not disputed the same.

Having considered the submissions made by the parties and perused the record, this Court is of the considered view that the writ petition can be disposed of with a direction to the respondents to consider the representation of the petitioner.

Accordingly, the writ petition is disposed of directing the respondents to consider the representation of the petitioner dated 18.01.2004 and pass appropriate orders thereon, in accordance with law, within four weeks from the date of receipt of a copy of this order.
