HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.4903 OF 2017 ORDER:

Though various issues have been raised in the writ petition, it is not necessary for this court to deal with the same, as the course of action has been agreed to between the petitioner and the respondent. The principal grievance of the petitioner is that petitioner is not being licensed to set up and carryon slaughtering of animals, for which the petitioner has applied for license invoking Section 272 of the A.P. Municipalities Act, 1965 (in short "the Act").

Learned counsel for the petitioner submits that the activity of business being carried out by the petitioner is lawful activity and he is willing to adhere to the lawful regulations and the requirements in terms of the Act and the Rules, the respondent authorities may be directed to consider the representation of the petitioner.

Sri N. Praveen Kumar, learned standing counsel for 3rd respondent, filed counter stating that as far back as on 27.04.2015 petitioner was intimated the necessary formalities that are required to be complied with. However, considering the fact that the learned counsel for the petitioner disputes the receipt of any such intimation, petitioner shall approach the 3rd respondent-Commissioner, Sadasivpet Municipality, and the 3rd respondent shall furnish a copy of the intimation notice dated 27.04.2015. Thereafter, the petitioner shall fulfil the shortcomings, as mentioned in the intimation notice dated 27.04.2015, and resubmit the application and the respondent authorities shall process the said application within six months from the date of submission by the petitioner, strictly in accordance with law.

With the above direction, the writ petition is disposed of. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed. ________________________ CHALLA KODANDA RAM, J Date:21.03.2017.
