This Transfer Criminal Petition is filed by the petitioner under Section 407 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking to withdraw the STC No.09 of 2021 from the file of Junior Civil Judge-cum-Judicial First Class Magistrate, Chevella and transfer the same to Judicial First Class Magistrate, Ranga Reddy District.

Heard. Perused the record.

Learned counsel for the petitioner submits that the main ground on which the petitioner is seeking transfer of the case is that he has life threat from the respondent No.1 if he attends the Court at Chevella.

In the said circumstances, the Junior Civil Judge-cum-Judicial First Class Magistrate, Chevella is directed not to insist upon the appearance of the petitioner on every date of hearing, unless specifically required. Accordingly the attendance of the petitioner is dispensed with. However, in the event of the Court insisting for his
Tr.Crl.P.No.26 of 2022 appearance on any specific date, the petitioner shall appear and the concerned police shall give protection on the said date and the petitioner shall intimate the police regarding his appearance before proceeding to Chevella. By virtue of this order, the petitioner shall not take unnecessary adjournments in the trial Court. In the event of the petitioner delaying the process of trial, the learned Magistrate is at liberty to seek his appearance in accordance with law. 5.
